Both public and private property owners have a legal responsibility to keep their property safe for visitors.

Premises Liability is an area of law often litigated that involves property owners, management entities, or tenants – such as shop owners, restaurants, or venues regarding the responsibility for maintaining a premise or property in a reasonable condition and that is safe from defects or hazards. When they do not, either intentionally or unintentionally, that is known (legally) as negligence. If someone is injured on their property because of their negligence, they can be held accountable for the costs associated with that person’s injuries.

Slip and fall incidents might be what most people think of when they think of premises liability – a slip and fall in a grocery store due to a wet spot or leak, for example. However, premises liability covers more than just slip and fall accidents including dog bites, swimming pool accidents, bar fights, elevator and escalator accidents, amusement park accidents, snow related falls, fires, flooding, toxic fumes or chemicals, assaults, and more can also be considered grounds for a premises liability claim.

To prove and succeed in a successful premises liability case you’ll be required under Florida law to prove all four elements of a negligence action:

  1. The property owner or manager owed you a duty of care (and, not everyone is owed a duty);
  2. The property owner or manager breached the duty of care owed to you;
  3. This breach caused you to suffer injuries; and
  4.  Actual damage resulted to you
